If an Extended Service Endorsement is desired, access to and use of both the software and information may be made accessable beyond the individual. Endorsements are available for a Club or Group, one advisor or consultant and the immediate family. Immediate family members include spouses, brothers, sisters, parents or children. One advisor may be an accountant or perhaps an investment advisor. A club or group may extend access to as many as 25 individuals. However, the total number of downloads is limited by the account. Extending access to the information for any group, family or advisor may require a redistribution.

Notwithstanding an Extended Service Endorsement, only the primary account holder is entitled to support and/or assistance directly from Nexusys. Any costs associated with the redistribution of the software and/or information remains the responsibility of the account holder.

The software provided to access the analyzes may be changed or updated frequently. The subscriber is entitled to all updates/changes that are released during the subscription period for the software.

The precalculated portfolio analyzes are intended to be updated and made available for download on a weekly basis. Individual subscribers may elect to be notified by email as updated versions become available. The number of downloads permitted during a subscription period is sufficient for a download each week plus a number of extra downloads to account for possible failures, etc. If you experience serious trouble in getting quality downloads you might want to consider getting the software and updates via DVD. The number of downloads permitted may also be adjusted as necessary.

And, finally it is very important that you read and understand the key obligations of any individual reviewing or auditing this information as detailed at each running of the Nexusys Auditor Program. Nothing about these analyzes serves as any kind of predictor or forcastor for investment made via Prosper. It is strickly historical data. No prediction or forcasting is involved. And, it is very important that individual subscribers understand the limitations of these analyzes and agree to the terms for their use.

All of the analyzes prepared by NexuSys and available to subscribers are historical in nature. Nothing within these analyzes attempts to predict or forecast the future. These are not economic studies. Nor are they in any way an attempt to predict what rates of return might be realized by investing in Prosper loans in the future. Indeed there is no information available that sheds any light on who might list loans on Prosper or how they may perform in paying back those loans.

This application has been designed and developed with the utmost in care and understanding about the responsibilities of the software developer as well as those who wish to use the application in formulating investment objectives.

It is important right up front that the user understand that no information provided with this application is expected to be taken or accepted without question, challenge and indeed a dialog with the developers. This is not a confidence game neither a situation where anyone is expected to just trust the information provided. On the contrary, individuals are expected to challenge any assumptions made during the analysis process and indeed consider the very real possibility that the outcome could be much different if and when different assumptions are made. Indeed different results would be shown if different assumptions are made.

Nothing in this application or the associated services is intended to suggest that the many assumptions necessary to complete the analysis process are indeed appropriate. That is an determination that only the user can make.

In order to make that determination the various assumptions must be understood. And it is the duty and responsibility of the user to do so to their own level of understanding and indeed the full application of their own expertise.

The application and associated services are intended to provide assistance to the user in a number of ways. But, no analysis can substitute for common sense and indeed special knowledge that may be required to participate in the Prosper marketplace.

Considerable effort has been made to provide the complete details of all assumptions made during the preparation of these portfolio analyzes and to provide the full details of all of the calculations required thereof. Considerable effort has also been made to provide the ability to completely audit each analysis. And it is the duty and responsibility of the user to do precisely that.

Having laid out this duty and responsibility of the user, it must also be noticed that the effort required to completely audit these analyzes can be daunting to say the least. However, it remains that the individual investor is obligated to conduct whatever review is deemed appropriate toward that end.

Thus it must be said and agreed that neither NexuSys nor Prosper is liable for any error or omission of information or data that might render an analysis less than completely accurate or possibly misleading. It must also be agreed to by the user that no investment decisions will be reached or implemented until such time that the individual investor has in fact audited the relevant analyzes and found them to be sound. If the user does not feel comfortable accepting this duty and responsibility, the use of this application and the associated portfolio analyzes for any purpose is prohibited.
